Terms of Service
These Terms of Service (the "Terms") are a legal agreement between Kilasec ("we", "us") and the organization on whose behalf you accept them ("Customer", "you"). By requesting access to, or using, the Kilasec cloud console and APIs (the "Service") or the Kilasec collector and related software (the "Software"), you agree to these Terms.
During the private beta, the Kilasec Beta Program Agreement also applies and controls over these Terms where they conflict.
1. The Service
Kilasec is a network security product that inspects AI/LLM traffic and applies your policy (allow, block, redact, hold for approval, or log). The collector runs on your network; the cloud console manages policy and shows decisions. See our Privacy Policy for how data is handled.
2. Accounts
You're responsible for your account credentials and for activity under your workspace. Keep credentials confidential, use strong authentication (we support two-factor), and notify us of any unauthorized use.
3. Authorization to intercept
The Software performs TLS interception of traffic you route through it. You represent that you are authorized to inspect that traffic on the networks and devices where you deploy Kilasec, that you will obtain any consents and give any notices required by law or by your agreements with your personnel, and that you will distribute the collector's CA only to devices you are permitted to inspect. You are responsible for lawful use of interception in your jurisdiction.
4. Acceptable use
You will not: use the Service unlawfully or to violate others' rights; reverse-engineer or attempt to extract source code except as permitted by law; resell the Service without our consent; interfere with or probe the Service's security; or use it to build a competing product. The Software is licensed, not sold, under the Kilasec Proprietary License.
5. Customer data and privacy
Data handling is described in the Privacy Policy. In brief: request/response content and the collector's signing key stay on your network by default; only decision metadata reaches our cloud unless you opt in. You are the controller of your workspace data; we act as your processor for collector telemetry.
6. Fees
The Service is currently offered free of charge during the beta. If we introduce fees, we'll give at least thirty (30) days' notice and you may decline by discontinuing use before they take effect.
7. Intellectual property
We own the Service and Software and all related IP. You own your data and your policies. Feedback you give us may be used to improve the product without restriction or obligation.
8. Warranty disclaimer
THE SERVICE AND SOFTWARE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SOFTWARE WILL DETECT, REDACT, OR BLOCK ANY PARTICULAR DATA OR THREAT. NO DETECTION TECHNOLOGY IS PERFECT; YOU REMAIN RESPONSIBLE FOR YOUR SECURITY AND COMPLIANCE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA; AND (b) OUR TOTAL LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED ONE HUNDRED US DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PRIOR TWELVE MONTHS, WHICHEVER IS GREATER.
10. Term and termination
These Terms apply while you use the Service. Either party may stop at any time. We may suspend or terminate access for breach, legal risk, or misuse. On termination, your right to use the Service and Software ends; sections that by their nature should survive (e.g. 7–9, 11) survive.
11. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. The state and federal courts located in El Dorado County, California have exclusive jurisdiction, and each party consents to venue there.
12. Changes
We may update these Terms; material changes get at least thirty (30) days' notice, and we'll update the version and date above. Continued use after the effective date is acceptance.
